1- GENERAL TERMS OF SALE at August 12th 2021
Article 1. Applications of the General Terms of Sale
1.1 These general terms of sale apply to all orders of Internet tickets placed on the website https://navette.parcduverdon.fr/, managed by the Parc naturel régional du Verdon from August 12th 2021.
The Parc naturel régional du Verdon reserves the right to adapt or modify them at any given time. In this case, the general terms of sale in effect on the day of the order will be applied.
The online booking respects the GDPR (General Data Protection Regulation), the new European regulations relative to the protection of personal data which came into effect throughout the European Union on May 25th 2018, and concern: the securing of data, the terms of data use (legal disclaimer), access to personal data.
Article 2. Contractual relations
Within the framework of our General Terms of Sale, the term ‘'customer'' defines the person who places an order on the central booking service whereas the term "passenger" concerns all the persons using the shuttle (a customer orders for x passengers).
2.1. The information on the customer for the current year may be subject to modifications of which the customer will be informed beforehand at the end of their order.
2.2. The Parc naturel régional du Verdon is the customer's only contact and is liable to them for the performance of the obligations resulting from these terms of sale. The Parc naturel régional du Verdon may not be held liable for damage resulting from force majeure or by any third party to the organisation and the performance of the shuttle service.
2.3. The customer recognizes that they are able to contract under the conditions described in the following sales terms: be at least 18 years old, be lawfully capable of contracting and must not be under guardianship or tutelage. Failing this, the Parc naturel régional du Verdon reserves the right to cancel the order.
2.4 The seats offered in the shuttles on the website https://navette.parcduverdon.fr/ are governed by these sales terms, are normally valid as long as they remain online until there are no allocated seats left. De facto, they may vary in real-time.
Article 3. Fares and regulations
3.1. The prices shown on the website of the current season are applicable until the end of the year and are Tax Inclusive. They are defined according to the current economic conditions in effect on the date the fares are fixed.
The customer has 15 minutes from the time of selecting seats to validate their purchase. Beyond this time, the seats are automatically put back on sale.
3.2. All payments must be made in Euros by authorized credit card. Full payment is required for all orders placed on the website. No other payment methods are accepted. The Parc naturel régional du Verdon is not liable for any fees on credit card transaction, resulting if applicable appropriate from the variation in the exchange rate or for other reasons.
3.3. The date of the validation of the order for the tickets corresponds to the order date and its online credit card payment (law of 13th March 2000 on electronic signature).
3.4. The payment by credit card is carried out on the banking servers of our partner Payfip and our service provider Xsalto. This implies that none of the customer's bank details transit via the website https://navette.parcduverdon.fr/. Payment by credit card is therefore perfectly secure; the customer's order will thus be registered and validated as soon as payment is accepted by the bank chosen by the customer.
3.5. The details of the customer's credit card are encrypted with the SSL (Secure Socket Layer protocol) and never transit uncoded on the network. The payment is made directly to the bank. The Parc naturel régional du Verdon has in no case access to these details. It is for this reason that they are requested from the customer each time they make a new transaction on our site.
3.6. For the safety of the online sale of the tickets, the 3D Secure system has been set up. This is a protocol which requires additional identification by the customer, in order to efficiently combat credit card frauds on the Internet.
3.7. The Parc naturel régional du Verdon reserves the right to refuse to honour an order of tickets from a customer with whom there is a dispute currently being resolved.
Article 4. Validity of the order of tickets on the Internet
4.1. The orders of Internet tickets dated and purchased via the website https://navette.parcduverdon.fr/ are valid only for the date and time chosen by the customer when ordering. Change of date, time or contents is not possible once the order has been confirmed. The customer can cancel the booking as explained in Article 6.
4.2. Orders of Internet tickets must be placed before 6 pm. on the day before departure.
4.3. Reduced price orders of Internet tickets(children under 12) will be subject to being checked by the driver on presentation of proof of identity (identity card or civil status documents) when boarding. The reference age is that of the day of using the shuttle.
If no proof of identity is produced, the driver has the right to ask for the difference with the full price ticket in effect on the date of using the service.
4.4. The Parc naturel régional du Verdon may not in any case be held liable particularly for the loss or theft of the ticket order. No duplicates can be issued on board.
Article 5. Presentation of Internet ticket orders
5.1. The Internet ticket entitled "order confirmation" received by email on completion of the order process must be presented to the driver. This document can be presented printed on white paper, or digitized on a portable digital apparatus. The internet ticket guarantees priority boarding before the other passengers who buy their ticket on board without having used the booking site.
The Parc naturel régional du Verdon declines all responsibility for problems which may occur during the ordering, processing, downloading or printing of an Internet ticket order that the customer can print or download.
5.2 Printed document: the printing function or ticket orders via the Internet imply that said documents be printed on a standard printer from Internet access.
The customer must ensure that the printed ticket orders are sufficiently well printed and must correspond without fail to the conditions of validity described below. Partially printed, dirty, damaged or unreadable documents will not be accepted and will be considered as non-valid.
Documents presented from a digital medium: order confirmation may not be shown to the driver on a portable digital apparatus).
Connection to telephone networks or the internet in the area is not guaranteed. This implies that the customer has downloaded and memorized said document before coming and that they have ensured that their mobile apparatus is functioning correctly, in particular the charging of its batteries because there is no possibility of charging an apparatus on the sites concerned.
5.3 Each ticket order printed or downloaded must be presented to the driver when boarding the shuttle. Any delays will be considered as a withdrawal and no refund will be possible. The customer's absence or that of one or several passengers for whom they have booked one (or several) seats, delays and non-presentation of the order confirmation by the customer will not be subject to postponement or refund.
Article 6. Ticket cancellation and refund
6.1 Cancellation requests:
Orders of Internet tickets are personal and not transferable. They cannot be exchanged or modified. Under Article L.121.21-8 12° of the French Consumer Code, they are not subject to right of withdrawal. All purchases of tickets are therefore final and cannot result in withdrawal by the customer.
The only possibilities of modification or refund of tickets are described hereafter:
6.1.1 Modification of ticket:
If a request is made at least 8 working days before the date of the journey ordered, it may give rise to a change. The change may involve postponing the journey to a later date in the same calendar year, for the same type of journey (return journey, single journey) and the same number of people.
Special case during an orange weather alert for all weather phenomena on the https://vigilance.meteofrance.fr/fr website: The Verdon Regional Nature Park will offer the customer the possibility of requesting cancellation of the ticket and reimbursement (see 6.1.2) or modification of the ticket at a later date. This information will be sent to the customer by SMS and email the day before the journey, as soon as the risk level has been notified (in principle at 4pm on the https://vigilance.meteofrance.fr/fr website).
To change their ticket, customers must submit their request using the online form on the booking website ("Useful links" page: click on "Contact us").
The Verdon Regional Nature Park will cancel the order and issue a credit note. In order to benefit from a credit note, the customer must have created an account (at the time of ordering or at a later date).
Once the account has been created by the customer and the credit produced by the Verdon Regional Nature Park, the customer will then be able to use their credit when placing a new order. The Parc du Verdon cannot be held responsible for any unavailability of places that do not meet the customer's requirements when the customer places a new order.
Any credit note generated but not used during the shuttle service year cannot be reimbursed.
6.1.2: Refund of ticket:
The Parc naturel régional du Verdon hereafter defines the conditions for refunding of tickets:
- When the delay is caused by an event beyond the responsibility of the carrier (traffic jam, accident, weather event slowing or blocking traffic, force majeure, etc.), the customer is not refunded.
- If the customer at the time of boarding arrives with a pet, and because animals are prohibited on board, (and on the Blanc-Martel trail), the customer's boarding will not be permitted and they can not ask for their ticket to be refunded.
- Cases resulting in refund:
- In the event of cancellation of the service on the part of the Verdon Regional Nature Park (decision taken on site by the driver and confirmed by the Verdon Regional Nature Park, due to the weather conditions at the time on Méteo France red alert for all the phenomena identified on the https://vigilance.meteofrance.fr/fr website, safety conditions, vehicle out of service and absence of a back-up vehicle, malfunction of the ticketing system not allowing the sale of a reduced-price ticket when the customer can benefit from a reduced-price ticket (the amount of the difference is then reimbursed to the customer), the customer will be fully reimbursed for his or her order. Other reasons for cancellation, linked to a local risk situation (political, health, natural or technological disaster, etc.) may occur at any time. In all such cases, customers will receive a full refund.
- When the shuttle is over 2 hours late due to the carrier (breakdown, lack of service, delay, back-up vehicle), the customer receives a 100% refund of the price of the ticket.
- Special case in the event of an orange weather alert for all weather phenomena on the https://vigilance.meteofrance.fr/fr website: The Verdon Regional Nature Park will offer the customer the option of requesting cancellation of the ticket and reimbursement, or modification of the ticket to a later date (see 6.1.1). This information will be sent to the customer by SMS and email the day before the journey, as soon as the risk level has been notified (in principle at 4pm on the https://vigilance.meteofrance.fr/fr website).
- All requests for reimbursement, accompanied by supporting administrative documents (ticket, bank details) and mentioning the customer's postal address, must be sent either by registered post without acknowledgement of receipt to ‘Parc du Verdon, Domaine de Valx - Régie navette, 04360 Moustiers-Sainte-Marie', or via the online contact form on the https://navette.parcduverdon.fr/ website (click on ‘contact us' at the bottom of the website page), enclosing the aforementioned administrative documents. On the basis of all these elements, the Parc naturel régional du Verdon may, at its sole discretion, make a refund at the end of the Blanc-Martel shuttle service period and no later than December of the current year.
- All refund requests can not give rise to any other right to an indemnity other than the refunding of the amounts paid at the time of ordering (price of tickets purchased online).
Article 7. Specific provisions
7.1- The Blanc-Martel shuttle is programmed at precise times, mentioned on the site https://navette.parcduverdon.fr/ (menu "booking"). When booking a round-trip, each outbound time is associated with a return time calculated on the basis of the average length of the hike on the Blanc-Martel trail (at least 6½ hours) and mentioned on the customer's order confirmation. If a customer does not arrive at the time indicated on the ticket which allows them to use the return shuttle, he can take the previous or following shuttles programmed, if necessary, on the same day, subject to available seats and on presentation of their round trip ticket to the shuttle driver. No extra cost will be requested.
7.2- The drivers are transport professionals responsible for safety during the time of the shuttle's trip. They announce rules of prudence and safety with which the passengers must comply. The Parc naturel régional du Verdon can in no case be held responsible for any accidents caused by a passenger's imprudence. In the mountains, the weather can change fast, and the driver is the only person authorised on board to make any decisions relative to the trip. He will evaluate the situation on departure or during the itinerary and will make in any case a suitable decision (continue trip, return to the place of departure or cancellation). Only cancellation by the driver will be subject to a refund (art.6).
Article 8. Various provisions
These special terms of sale are subject in both their interpretation and their implementation, to French law. Failing an amicable settlement, the customer can apply, either to one of the territorially competent jurisdictions under the Code de Procédure Civile, or the jurisdiction of the location of the service provider.
2- GENERAL TERMS OF USE
Article 1. Object
These General Terms of Use are designed to define the procedures for making the service on the website https://navette.parcduverdon.fr/, hereafter known as the "Service" available and the terms of use of the service by the user.
All access and/or use of the site https://navette.parcduverdon.fr/ suppose the acceptance and respect of the terms of these terms and their unconditional acceptance. They therefore represent a contract between the service and the user.
Article 2. Definitions
• User: the user is any person using the site or one of the services offered on the site.
• Email address: the term "Email address" means the email message address which will serve for all communication between the user and the site.
• Password: The "Password" is confidential information, that the user must keep secret, and which allows them, along with his email address, to prove their identity.
Article 3. Terms of use
The service is accessible free of charge to all users who have access to the internet. All costs relative to access to the service, whether hardware, software or internet access costs, are exclusively borne by the user. They are solely responsible for the correct operation of their data-processing equipment and their access to the internet.
Certain sections of the site are reserved for users identified by their email address and their password.
The user undertakes not to take on the identity of a third party.
The user undertakes not to divert the service for their own purposes.
The user undertakes not to use the service to transmit to the Parc naturel régional du Verdon any racist, negationist, sexist, homophobic, paedophile, discriminatory statements or those likely to harm the dignity of another person or the public order.
The user undertakes not to use the service to transmit to the Parc naturel régional du Verdon data or information without respecting the applicable regulations (copyright, respect of privacy, image rights).
The Parc naturel régional du Verdon reserves the right to refuse or withdraw access to the service, unilaterally and without prior notice, to any user who does not respect these general terms of use.
The Parc naturel régional du Verdon implements all reasonable means available to ensure quality access to the service but is bound by no obligation to do so.
Furthermore, the Parc naturel régional du Verdon cannot be held liable for any failure of the network or the servers or any other event beyond their reasonable control, which would prevent or impair the service.
The Parc naturel régional du Verdon reserves the right to interrupt, momentarily suspend or modify without notice access to all or part of the service, to guarantee the maintenance, or for any other reason, without the interruption resulting in any obligation or compensation.
Article 4. Ownership and responsibility
Thsi site is the property of the Parc naturel régional du Verdon. All the elements of this site are protected by copyright " Parc naturel régional du Verdon ".
The Parc naturel régional du Verdon is responsible for all the textual information contained on the site. Their responsibility cannot, however, be incurred for the information contained:
• on the websites which direct, using a hypertext link, to this website
• on the websites which produce, without authorisation, the contents of this site
Despite the care taken by the Parc naturel régional du Verdon, the information contained on the website https://navette.parcduverdon.fr/ are given as an indication and is subject to change without notice. Consequently, the user recognizes that they use this information under their exclusive responsibility.
The Parc naturel régional du Verdon authorizes all websites or any other support to quote them or to set up a hypertext link towards its contents, subject to the page reached not being nested within other pages, particularly by frames (or "eframes") i. e., that the pages of the website of the Parc naturel régional du Verdon are not nested within the pages of another website, but are accessible on opening a window.
